The definitions found in Neb. Rev. Stat. §§ 20-304 to 20-317, 20-319(6), 20-320(2), 20-322(4) (b), 20-327 and 20-333 are incorporated by this reference into all chapters of this Title. &nbsp;</span></p><p><strong><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002 Other&nbsp;Definitions</span></u></strong><span style=\"font-family: Arial, Helvetica, sans-serif;\"> &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.01</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Act shall mean the Nebraska Fair Housing Act, Neb. Rev. Stat. §§ 20-301 to 20-344 as amended. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.02</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Chair shall mean the Chairperson of the Nebraska Equal Opportunity Commission, or in the absence of Chair, the Vice Chair, or, in the absence of both, any member of the Commission designated by the Chair or a majority of the Commission to serve.&nbsp;The term “Commissioner” shall mean any member, including the Vice Chair and the Chair of the Commission. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.03</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Charge shall consist of a short and plain statement of the facts upon which the Commission has found reasonable cause to believe that a discriminatory housing practice has occurred or is about to occur, shall be based on the final investigative report, and need not be limited to the facts or grounds alleged in the complaint filed under section 20-326. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.04</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Complaint shall mean a written statement under oath or affirmation, filed with the Commission by a person claiming to be aggrieved, setting forth time, place, and facts of an unlawful act alleged to have been committed by a respondent. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.05</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Complainant means the Commission or any person filing a complaint. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.06</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Conference shall mean a method in which the Commission brings together the complainant(s) and respondent(s) to a complaint, with or without witnesses, to give testimony in the course of an investigation. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.07</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Discriminatory practice or unlawful act&nbsp;shall mean any of the acts, conduct and matters defined as constituting discriminatory practice by Neb. Rev. Stat. §§ 20-318 through 20-321, and section 20-344 of the Act. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.08</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Executive Director shall mean an employee of the Commission, selected by, and serving at the will of the Commission as Executive Director, who shall have such duties, powers and authority as may be conferred upon her or him by the Commission, subject to the provisions of the Act. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.09</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Party or parties shall mean either the complainant or the respondent, or both. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.10</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Personal service means handing a copy of the document to the person to be served or leaving a copy of the document with a person of suitable age and discretion at the place of business, residence or usual place of abode of the person to be served. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.11</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Receipt of notice means the day that personal service is completed by handing or delivering a copy of the document to an appropriate person or the date that a document is delivered by certified mail. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.12</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Respondent shall mean a person the person or entity accused in a complaint of a discriminatory practice and any other person or entity identified in the course of investigation and joined as a respondent pursuant to section 20-326(2) of the Act. &nbsp;</span></p><p><strong><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">003 Constitutionality</span></u></strong><span style=\"font-family: Arial, Helvetica, sans-serif;\"> &nbsp;</span></p><p><span style=\"font-family: Arial, Helvetica, sans-serif;\">If any section or any part of any section of 140 NAC 1 through 140 NAC 4 is declared invalid or unconstitutional, such declaration of invalidity shall not affect the validity of the remaining portions thereof. &nbsp;</span></p>","appendixNumber":null,"titleId":86,"recordStatusId":null,"dateFiled":null,"effectiveEndDate":null,"renewCount":0,"emergencyRegulationId":null,"isEmergency":false},{"id":652,"chapterName":"HANDLING OF COMPLAINTS UNDER THE FAIR HOUSING ACT","chapterNumber":"2","effectiveDate":"2008-08-20T00:00:00","pdfContainerName":"chapter-pdfs","pdfBlobName":"140 NAC 2 (08-20-2008).pdf","officialPdfBlobName":null,"certificateOfAdoptionBlobName":null,"chapterHtml":"<p><strong><span style=\"font-family: Arial, Helvetica, sans-serif;\">TITLE 140: NEBRASKA EQUAL OPPORTUNITY COMMISSION &nbsp;</span></strong></p><p><strong><span style=\"font-family: Arial, Helvetica, sans-serif;\">CHAPTER 2: Handling of Complaints under the Fair Housing Act &nbsp;&nbsp;</span></strong></p><p><strong><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">001 Who&nbsp;May File A Complaint</span></u></strong><span style=\"font-family: Arial, Helvetica, sans-serif;\"> &nbsp;</span></p><p><span style=\"font-family: Arial, Helvetica, sans-serif;\">Any person who claims to have been aggrieved personally by an unlawful act may file a complaint with the Commission.&nbsp;Said complaint may be filed by the aggrieved party, or a complaint may be filed by a legal guardian or an individual with a power of attorney on behalf of another person who claims to be personally aggrieved by an unlawful act.&nbsp;The Commission may investigate housing practices to determine whether a complaint should be filed and may file a complaint on its own initiative. &nbsp;</span></p><p style=\"margin-left: 60px;\"><span style=\"font-family: Arial, Helvetica, sans-serif;\">Source: </span><em><span style=\"font-family: Arial, Helvetica, sans-serif;\">Neb. Stat. §§</span></em><span style=\"font-family: Arial, Helvetica, sans-serif;\"> 20-326, 20-314 &nbsp;</span></p><p><strong><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002 Form and Information</span></u></strong><span style=\"font-family: Arial, Helvetica, sans-serif;\"> &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.01 Form</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">.&nbsp;A complaint is filed when it is received by the Commission, is in writing or reduced to writing, and reasonably contains the information set forth in 002.02. The complaint must also be signed and notarized. Notary service will be provided without charge by the Commission. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.02 Contents</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">. The original complaint shall be filed within one (1) year of the alleged discriminatory housing practice has occurred or terminated. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">003.02 Filings, Where Made</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">. Complaints and other documents are “filed” when received by the Commission. Complaints shall be filed at any office of the Commission as set forth below.&nbsp;Thereafter, whenever filings are required, they shall be made with the Commission addressed or delivered to the Nebraska Equal Opportunity Commission at the office prescribed by the Commission. Filing&nbsp;shall be made by personal delivery, by mail, or by facsimile or other electronic methods authorized by the Commission, and will be received during regular business hours of the Commission.&nbsp;Regular business hours for the Commission are from 8:00 a.m. to 5:00 p.m., in the relevant time zone, Monday through Friday, exclusive of state or federal holidays. An attorney representing any party in any investigation shall file her or his appearance with the Commission, and thereafter all documents served by the Commission may be served upon said attorney instead of upon the party she or he represents, until said attorney or said party notifies the Commission in writing that said attorney no longer represents, or is authorized to represent, said party. &nbsp;</span></p><p><strong><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">006 Conciliation&nbsp;Process</span></u></strong><span style=\"font-family: Arial, Helvetica, sans-serif;\"> &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">006.01 Conciliation Process, Agreement and Breach</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">.&nbsp;During the period beginning with the filing of a complaint and ending with the filing of a charge or dismissal of the complaint, Commission staff shall, to the extent feasible, engage in conciliation with respect to the complaint.&nbsp;If it appears that a conciliation conference would be beneficial and the parties agree to participate, a conference will be scheduled. The Commission shall</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">: &nbsp;</span></p><p style=\"margin-left: 60px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">001.02A</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> make information available to the aggrieved person and respondent derived from an investigation and any final investigative report relating to that investigation, upon request, following the completion of the investigation, as provided by section 20-330(2) of the Act. &nbsp;</span></p><p style=\"margin-left: 90px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">001.02A1 Limitation on Release</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">.&nbsp;Under section 20-330(2)(b) of the Act, this release is subject to the federal Privacy Act of 1974, Public Law 93-579, as such act existed on January 1, 2005, and any other state or federal laws limiting the release of confidential information obtained in the course of an investigation under the Act. </span></p><p style=\"margin-left: 60px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">001.02B</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> disclose materials in the investigative file to the complainant and respondent to the extent reasonably necessary to further the investigation or conciliation process, as provided by section 20-330(3) of the Act. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">001.03 Records&nbsp;of Hearings</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">.&nbsp;The transcript and record of hearing on any contested case is a public record, except for any evidence received in camera pursuant to the Rules of Practice and Procedure, 144 NAC 1 - 007.02A, or otherwise protected under the rules applicable to civil cases in Nebraska district courts pursuant to section 20-336(1) of the Act, or under state public records laws. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">001.04 Dismissals</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">. An order dismissing a charge is subject to public disclosure under sections 20-333 (1)(c) and 20-337(7) of the Act. &nbsp;</span></p><p><strong><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002</span></u></strong><span style=\"font-family: Arial, Helvetica, sans-serif;\"> Process for Review of Investigative Records under 20-330(2) &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.01 Location of Review</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">. Any review of records by an aggrieved person or respondent under section 20-330(2), not otherwise confidential or privileged, shall occur at one of the Commission offices in Lincoln, Omaha, or Scottsbluff. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.02 Request for Review</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">. An aggrieved person or respondent seeking review shall submit a request for review by delivery, by mail, by facsimile, or electronically. All requests for review shall be: &nbsp;</span></p><p style=\"margin-left: 60px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.02A</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> made in writing to the Executive Director; &nbsp;</span></p><p style=\"margin-left: 60px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.02B</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> directed to the principal office of the Commission; &nbsp;</span></p><p style=\"margin-left: 60px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.02C</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> include the appropriate NEB case number and case name; &nbsp;</span></p><p style=\"margin-left: 60px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.02D</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> be accompanied with a copy of a letter of representation, if the record is to be reviewed by counsel for a party; and &nbsp;</span></p><p style=\"margin-left: 60px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.02E</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> provide the date and Commission office for which review is requested. &nbsp;</span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.03 Timeline for Requests for Review</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">. Because&nbsp;all investigative files are stored in Lincoln at the principal office of the Commission or in off-site storage, requests for review must be submitted: &nbsp;</span></p><p style=\"margin-left: 60px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.03A</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> at least ten (10) days prior to the date on which review is requested for parties who wish to review records at Commission offices outside of Lincoln; or &nbsp;</span></p><p style=\"margin-left: 60px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.03B</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\"> at least three (3) days prior to the date on which review is requested for parties who wish to review records at Commission offices in Lincoln. The Commission will provide the files for review within such times if the files are available. In&nbsp;all cases, when the file becomes available at the site for review, the Commission will notify the requester.&nbsp;If, within seven (7) days after such notice, the requester has not conducted the review or made other arrangements for review, the file will be returned. </span></p><p style=\"margin-left: 30px;\"><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">002.04 Reproduction&nbsp;of Files</span></u><span style=\"font-family: Arial, Helvetica, sans-serif;\">. Documents&nbsp;may not be copied in the course of a file review but tapes may be listened to and documents may be examined. If the file review is not completed on the arranged date, it may be continued at a date and time thereafter as arranged between the Commission and requester, without submission of an additional request. &nbsp;</span></p><p><strong><u><span style=\"font-family: Arial, Helvetica, sans-serif;\">003 Review&nbsp;of Public Records</span></u></strong><span style=\"font-family: Arial, Helvetica, sans-serif;\"> &nbsp;</span></p><p><span style=\"font-family: Arial, Helvetica, sans-serif;\">Public records shall be made available to the public for examination, free of charge, during regular business hours, at the Commission’s principal office in accordance with Public Records Law, Neb.
